Turbary rights on Cors Fochno, 1823



Generglyn Inclosure.

WE, the undersigned, being the Commissioners named and appointed for carrying into execution an Act of Parliament, made and passed in the 53rd Year of the Reign of His late Majesty King George the Third, entitled, "An Act for Inclosing Lands in the several Parishes of Llanfihangel-Generglyn and Llanganfelin, in the County of Cardigan,"

DO HEREBY GIVE NOTICE,

That we have set out and allotted for Turbaries, for the use of the Poor, unto the Lord of the Manor of Generglyn, and unto the Churchwardens and Overseers of the Poor of the Parishes of Llanfihangel-Generglyn and Llanganfelin, for the time being, as Trustees for such of the Poor as reside and are legally settled in such parts of the said Parishes as are within the said Manor or Lordship of Generglyn.

For the Poor of that part of the Parish of Llanfihangel-Generglyn,

that reside within the Manor or Lordship of Generglyn.

All that Piece or Parcel of Marsh Land, containing 51a. 2r. 10p. situate on Corsfochno, near Ynys Capel, bounded on all sides by other parts of the said Marsh Lands, and marked by drains or a trigg cut in the sod.

Also all that Piece or Parcel of Marsh Land, containing 25a. 1r. 32p. situate near Ynys-hir, bounded on the North and East by part of the said Marsh Lands, on the South by Ynys-greigiog Lands, and on the West by Ynys-fechan Lands, and marked by drains or a trigg cut in the sod.

Also all that Piece or Parcel of Marsh Land, containing 70a. 0r. 0p. situate on Corsfochno, near Ynys-fergi, bounded by Pwll-du on the South, and on all other sides by parts of the said Marsh Lands, and marked by drains or a trigg cut in the sod.

For the Poor of the Parish of Llanganfelin.

All that Piece or Parcel of Marsh Land, containing 65a. 0r. 10p. situate on Corsfochno, on the West side of the road leading from Llanganfelin Church to the Island of Mochno, bounded on the North and West by parts of the said Marsh Lands, and on the South by Ynys Canfelin Lands, and marked by drains or a trigg cut in the sod.

Also all that Piece or Parcel of Marsh Land, containing 25a. 1r. 20p. situate on Corsfochno, near Commins-y-Dafarn-fach, bounded on the East by the intended new road leading from thence to the Neuadd, and on all other sides by parts of the said Marsh Lands, and marked by drains or a trigg cut in the sod.

AND WE DO HEREBY ORDER AND DIRECT, That the Churchwardens and Overseers of the Poor of the said Parishes of Llanfihangel-Generglyn and Llanganfelin, for the time being, shall make, keep, preserve, and maintain, a good and sufficient Fence about the said Allotments, on all parts, (except such parts as are already fenced in by old Inclosures,) and shall cleanse, scour, keep open, and in good order, the drains adjoining the aforesaid Allotments, for such Allotments as are respectively allotted to each aforesaid Parish. AND WE DO HEREBY FURTHER GIVE NOTICE, That all right of Common of every kind whatsoever, in, over, or upon the said Marsh Lands or Grounds allotted as aforesaid, shall, from and after the 20th day of May now next ensuing, cease, determine, and be for ever extinguished.

AND WE ALSO HEREBY GIVE NOTICE, That we have set out and allotted to all Persons who are entitled to Common of Turbary on the said Commons or Waste Lands, who reside in the Parishes of Llanfihangel-Generglyn and Llanganfelin, and within the Manor or Lordship of Generglyn, the following Pieces or Parcels of Land, for Turbaries.

For Persons residing in that part of the Parish of Llanfihangel-Generglyn,

within the Manor or Lordship of Generglyn.

All that Piece or Parcel of Marsh Land, containing 45a. 1r. 12p. situate on Corsfochno, near Ynys Capel, bounded on all sides by other parts of the said Marsh Lands, and marked by drains or a trigg cut in the sod.

Also all that Piece or Parcel of Marsh Land, containing 70a. 0r. 0p. situate on Corsfochno, near Ynys-fergi, bounded on the South by an Allotment made for the Poor of the Parish of Llanfihangel-Generglyn, and on all other parts by the said Marsh Lands, and marked by drains or a trigg cut in the sod.

Also all that Piece or Parcel of Marsh Land, containing 18a. 2r. 24p. situate near Ynys-hir, bounded on the South by an Allotment made to the Poor of the Parish of Llanfihangel-Generglyn, on the North by part of the said Marsh Lands, on the East by Lands claimed by the representatives of the late Matthew Davies, Esq., and on the West by Ynys-fechan Lands, and marked by drains or a trigg cut in the sod

For Persons residing in the Parish of Llanganfelin.

All that Piece or Parcel of Marsh Land, containing 50a. 2r. 6p. situate on Corsfochno, near Erglodd, bounded on the East by an Allotment made for the Poor of the Parish of Llanganfelin, on the West by an Allotment made for the Poor of the Parish of Llanfihangel-Generglyn, and on the North and South by parts of the said Marsh Lands, and marked by drains or a trigg cut in the sod.

And we have directed Maps or Plans to be made, with references thereunto, of the said Allotments, which said Maps or Plans are now left at the Dwelling-house of Hugh Rowland, in Tre'rddôl, in the Parish of Llanganfelin, for the space of One Calendar Month from the date hereof, for the inspection and examination of all Persons interested therein.

AND WE DO HEREBY ALSO FURTHER GIVE NOTICE, That if any Person or Persons shall cut, dig, pare, take, or carry away, any turf, peat, or soil, from the said Commons or Waste Lands, or any part thereof, (except from the Turbaries now allotted, or from the turf or peat that was cut last season, and is now in stacks or ricks on the said Commons or Waste Lands, which the owners thereof shall be permitted to take and carry away until the 10th day of June now next ensuing, but not afterwards, or they will be subject to the following Penalty,) he, she, or they will be immediately proceeded against as the Act directs, which enacts as follows: - "That if any Person or Persons shall, after such Turbary shall have been so set out and allotted, and previous to the execution of the award of the said Commissioners, presume to cut, dig, pare, grave, flay, or carry away, any turf or soil, in, upon, or from the said Commons or Waste Lands, or any part thereof, (except for such part or parts as shall be allotted for a Turbary as aforesaid,) every such Person or Persons being convicted thereof, either by his or her own confession, or upon the oath of one credible Witness, before one of His Majesty's Justices of the Peace for the said County of Cardigan, (not being interested,) who may summon the Parties concerned, and examine Witnesses upon oath relating to the said complaint, shall, for every such offence, forfeit and pay such sum of money as the said Justice shall appoint, not exceeding the sum of Ten Pounds; and it shall be lawful for such Justice by warrant under his hand and seal, directed to any Person or Persons whomsoever, to cause the said penalty to be raised and levied by Distress and Sale of the Goods and Chattels of the Person or Persons offending, with the Costs and Charges of such Distress and Sale, &c."

Any Person giving information of any Offender or Offenders, (to Thomas Beddoes, of Gwynfryn,) so that he, she, or they may be brought to justice, shall, upon conviction of the Offender or Offenders, receive one guinea reward, from us the undersigned Commissioners.
